Did Mark Kelley and Gabby Giffords commit a felony at the Saratoga Gun Show?

If you have not heard the news yet, (there are a couple links up over at The Gun Feed) Mark Kelley and Gabby Giffords attended a NY gun show in Saratoga the other day… Well, I will say right up front that I am not too familiar with NY gun law, so you all will have to help me out… Is this a felony:

Its my understanding that it’s against New York state law for someone to be in possession (holding) a handgun without a valid New York state pistol license. Its also impossible for Mark Kelly to have a New York state pistol license because he’s not a legal resident of New York State and they only issue licenses to state residents.

And oh BTW, thats the NYS Attorney General Eric Schneiderman standing right next to him while he may or may not be committing said felony.

Laws for thee, but not for wee anti-gun folks who are trying to disarm the civilian population!

  1. It may be or it may not… I dont know, but I DO know that they will certainly get the same David Gregory treatment if it indeed is.

  2. They may or may not be violating the law, but just like when a US Senator obtained prohibited weapons “for show” recently, they don’t get prosecuted for their crimes. Only pro-gun people do.

  3. I’m not certain it’s against the law but when you go to a gun store they will not let you hold a handgun unless you show them your permit first. That doesn’t even matter because the politicians who make the laws don’t even know the laws or what they mean!

  4. NY Penal Law: 400.00, Section 2:

    “A license for a pistol or revolver, other than an assault weapon or a disguised gun, shall be issued to (a) have and possess in his dwelling by a householder; (b) have and possess in his place of business by a merchant or storekeeper; (c) have and carry concealed while so employed by a messenger employed by a banking institution or express company……(f) have and carry concealed, without regard to employment or place of possession, by any person when proper cause exists for the issuance thereof….”

  5. It means, you need a NYS issued pistol license to have, keep, possess and carry a pistol or revolver in NYS…..

  6. The gun Kelly was looking at was an 1873 Colt single action army, which is an antique firearm under the laws of New York.

    It was not only perfectly legal for him to hold it, he could have bought it.
